Wills and Trusts
Wills - It’s always a good idea to have a Will, even if you’re hoping to avoid the probate process. I can assist in helping you prepare a valid Will that will communicate your wishes to the Court and your Executor.
Revocable Living Trusts - Especially if you have out of state real estate, Revocable Living Trusts are a tool that can help you avoid having your assets go through probate so long as you properly fund your Trust. We will talk about how a Revocable Living Trust is like a bucket that needs to be filled with your assets before you die and whether or not a Revocable Living Trust would be a useful estate planning tool for you.
Irrevocable Trusts - Typically used for tax planning or special asset protection, there are many different kinds of Irrevocable Trusts that may come into play if your situation calls for it. We can discuss whether or not an Irrevocable Trust is necessary, but most people do not need to utilize these more complicated Trusts.

Ancillary Documents
Disability Documents - Used when you are alive but unable to make decisions for yourself, every person over the age of 18 should have these documents in place which name an Agent to make decisions for them when they cannot do this themselves. I can help you prepare the following documents for yourself and anyone in your family who is over the age of 18:
Medical Power of Attorney: Names an Agent to make medical decisions for you if you cannot
Durable Power of Attorney: Names an Agent to sign documents and carry out transactions for you if you cannot
HIPAA: A list of people who are allowed to have access to your private healthcare information and speak with doctors directly about your medical issues
Advanced Healthcare Directives: Names an Agent to make end of life decisions (pulling the plug if you are on a life support machine) for you, with your guidance as to what your wishes are
Deeds - If you are having a Revocable Living Trust prepared, I will assist in preparing and recording any deeds to your Texas real estate to transfer them to the Revocable Living Trust. I can also help prepare and record other deeds such as Transfer on Death or Ladybird deeds if needed.
Assignment of Interest - If you are having a Revocable Living Trust prepared and you have an interest in an LLC, I can help prepare an Assignment of Interest in your LLC to a Revocable Living Trust.
Other Agreements - Depending on your situation, other agreements may be needed. We can discuss whether any other agreements are needed and whether I can assist with the preparation of these agreements.
Probate
If a loved one has passed away, and nobody is fighting over the estate, I can help you probate their Estate if it is needed. If there is a possibility that people are going to fight over the estate, I can refer you to several probate litigation attorneys who can help in your situation. I am very familiar with Travis and Williamson Counties and can also take on probate cases in Hays, Bastrop and Burnet Counties. If your loved one lived in a different county, I am happy to speak with you about the probate process in general, but it may be advisable to retain a probate attorney who is local in that particular county.
With a Will - If your loved one had a Will, I will need the ORIGINAL Will that was signed, along with a death certificate, and information on the assets and debts that exist in the estate. Please note that the original Will needs to be probated within 4 years of the date of death! If it has been over 4 years since the date of death, it is possible that the Will may still be admitted to probate, but it will be a more complicated process.
Without a Will - If your loved one did not have a Will, I will need a death certificate, information on the assets and debts that exist in the estate, and who the surviving family members are.
